By accessing and using FlashForge ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Description of Service

FlashForge is a web-based flashcard and study platform that allows users to:

• Create and manage flashcard decks stored locally in their browser
• Study flashcards using spaced repetition algorithms
• Optionally generate flashcards using AI technology
• Export and import their data for backup purposes

Local-First Application

FlashForge is a local-first application. All your flashcards, study data, and settings are stored in your browser's local storage (IndexedDB). We do not maintain user accounts or store your data on our servers.

Use of the Service

Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Use the Service to transmit malicious code, viruses, or harmful content
• Attempt to reverse engineer, decompile, or hack the Service

AI Generation Features

When using AI generation features:

• You are responsible for the content you submit for generation
• You must not submit copyrighted material without permission
• You must not submit illegal, harmful, or offensive content
• AI-generated content should be reviewed before use; we make no guarantees of accuracy
• AI generation is subject to rate limits and may be temporarily unavailable

Intellectual Property

Your Content

You retain all rights to the flashcards and content you create. Since your data is stored locally in your browser, you have full control over it.

Our Service

The Service, including its design, code, features, and branding, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without permission.

Data and Privacy

Please refer to our Privacy Policy for information about how we handle data. Key points:

• Your flashcard data is stored only in your browser
• We do not have access to your flashcard content
• AI generation content is processed by third-party AI providers (see Privacy Policy)
• You are responsible for backing up your data using the export feature

Disclaimers and Limitations

No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• Your data will never be lost (you should regularly export backups)

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Educational Use Disclaimer

FlashForge is a study tool. While we strive to support effective learning through spaced repetition algorithms, we make no guarantees about educational outcomes. Users are responsible for verifying the accuracy of their flashcard content.

Data Loss

Since FlashForge stores data in your browser:

• Clearing browser data will delete your flashcards
• Using incognito/private mode will not persist data
• Switching browsers or devices will not transfer your data
• You are responsible for exporting backups regularly

We are not liable for any data loss. Use the export feature to create backups.

Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We may also update these Terms of Service from time to time.

Termination

Since FlashForge does not use accounts, there is no formal termination process. You may stop using the Service at any time. To remove your data, simply clear your browser's local storage or use the delete data feature in settings.

Third-Party Services

The Service uses third-party services:

• Vercel AI Gateway/OpenAI - For AI flashcard generation (optional)
• Ahrefs Web Analytics - For anonymous usage analytics

Use of these services is subject to their respective terms and privacy policies.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
